1. Совет дома (СД) – это представительный орган, избранный собственниками помещений дома (более 50% голосов), который действует от имени и в интересах собственников жилых и нежилых помещений дома.
2. Статьей 161.1 Жилищного кодекса РФ устанавливается не право, а обязанность собственников помещений избирать Совет дома, если в доме не создано ТСЖ.
3. Члены Совета дома осуществляют свою деятельность на общественных началах. (зарплату не получают!)
4. Совет дома имеет право и обязан участвовать в решении вопросов, связанных с управлением и обеспечением нормальной жизнедеятельности дома (в отличие от отдельных собственников, в реальности лишенных такой возможности). Вот лишь некоторые направления деятельности Совета дома:
•контроль правомерности начислений платы на основании показаний общедомовых приборов учета;
•контроль целесообразности, качества, стоимости работ, выполняемых в доме сторонними организациями (подрядчиками), бремя оплаты услуг которых, так или иначе, ложится на каждого собственника;
•контроль деятельности «управляющей компании ЖСК», обоснованности предлагаемых тарифов, целевых и прочих сборов, законности принимаемых «управляющей компанией ЖСК» решений о выборе подрядчиков, содержания договоров, заключаемых «управляющей компанией ЖСК» с собственниками;
•предварительная проработка и вынесение на общее собрание собственников помещений дома любых вопросов, связанных с домом.
5. Основные функции, права и обязанности Совета дома подробно изложены в Положении о Совете дома, которое также будет представлено для утверждения общему собранию собственников.
